"Birchwood Rest" / "We" / "Us" / "Our"

Refers to Birchwood Rest, a residential boarding facility located at 47 Rosedale Valley Road, Toronto, ON M4W 1P7, Canada.

"User" / "You" / "Your"

Refers to any individual who visits our website, submits an inquiry, or communicates with Birchwood Rest in connection with residential services — including prospective residents and their family members or representatives.

"Services"

Refers to the residential boarding packages offered by Birchwood Rest, including Comfortable Room & Board, Social Engagement Program, and Full Concierge Living, as described on our website.

"Website"

Refers to the pages hosted at birchwoo.biz and all associated content.

"Agreement"

Refers to these Terms & Conditions, together with our Privacy Policy and Cookie Policy, which collectively govern your relationship with Birchwood Rest.

"Resident"

An individual who has entered into a formal residential boarding arrangement with Birchwood Rest.

2Acceptance of Terms

By visiting our website, submitting a contact form, or communicating with Birchwood Rest about our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

If you are acting on behalf of a prospective resident — for example, as a family member, legal guardian, or authorized representative — your use of this website confirms that you have the authority to enter into agreements on their behalf.

• Minimum age: You must be at least 18 years of age to submit inquiries or enter into a service agreement with Birchwood Rest.
• Legal capacity: By proceeding, you confirm that you have the legal capacity to enter into this agreement under the laws of Ontario, Canada.
• Continued use: Continued use of the website after any updates to these terms constitutes acceptance of the revised agreement.

3Service Description

Birchwood Rest offers non-medical residential boarding for older adults in a warm, home-like environment. Our services are designed to support daily living, social connection, and personal comfort — and do not include nursing care, medical supervision, or clinical health services of any kind.

The three residential packages we currently offer are:

• Comfortable Room & Board (CAD $215/month): Private or semi-private furnished room, three daily meals, weekly housekeeping, and access to shared common areas.
• Social Engagement Program (CAD $475/month): Includes all Room & Board features plus a curated weekly activity calendar and group transportation for outings.
• Full Concierge Living (CAD $1,060/month): Comprehensive residential package with private suite, laundry, personal transportation scheduling, and a dedicated staff coordinator.

Service availability is subject to room occupancy and operational capacity at the time of inquiry. Birchwood Rest reserves the right to adjust, update, or modify available service tiers with reasonable advance notice.

4Inquiries & Communication

Birchwood Rest does not maintain user accounts. Our website is primarily an informational resource, and contact forms are provided for the purpose of expressing interest or requesting more information about our residential services.

• Information submitted through our contact form is used solely to respond to your inquiry and to share relevant details about our services.
• We will make reasonable efforts to respond to inquiries within two to three business days.
• Submitting an inquiry does not constitute a reservation, agreement, or commitment of any kind on the part of Birchwood Rest.
• Please provide accurate information in any communications. We rely on the details you share to respond helpfully and appropriately.

5User Responsibilities

We ask that all visitors and prospective residents engage with our website and staff in a respectful and honest manner. Specifically, you agree to:

• Use the website only for lawful purposes and in accordance with these terms.
• Provide accurate and complete information in all communications and inquiry forms.
• Refrain from submitting false, misleading, or fraudulent information.
• Respect the privacy and dignity of current residents, staff, and other individuals connected with Birchwood Rest.

Prohibited activities include:

• Attempting to interfere with, disrupt, or gain unauthorized access to website systems.

7Fees & Payment

Monthly fees for residential services are established at the time a formal residency agreement is signed. All fees are quoted and charged in Canadian Dollars (CAD).

• Billing cycle: Residential fees are invoiced and due monthly, on a schedule agreed upon at the time of move-in.
• Payment methods: Accepted payment methods will be communicated during the onboarding process and may include electronic transfer, cheque, or pre-authorized debit.
• Pricing changes: Birchwood Rest reserves the right to adjust monthly rates with a minimum of 60 days' written notice to current residents.
• Deposits: A security deposit may be required prior to move-in. Terms for its application or return will be set out in the formal residency agreement.

Refund policy: Refund terms for monthly fees and deposits are set out in the individual residency agreement signed between Birchwood Rest and the resident or their authorized representative. We handle all refund matters with care and on a case-by-case basis.

• No warranty that services will be available at all times or that room availability will match a specific request.

10Limitation of Liability

To the fullest extent permitted by applicable law, Birchwood Rest shall not be liable for:

By using this website, you agree to indemnify and hold harmless Birchwood Rest, its staff, and affiliated parties from any claims, losses, or costs — including reasonable legal fees — arising from your violation of these Terms & Conditions, your misuse of the website, or any false information you have provided in connection with your inquiry or residency.

12Termination

These terms apply for as long as you interact with our website or maintain a residential arrangement with Birchwood Rest.

• By you: You may stop using this website at any time. Termination of a residency arrangement is governed by the terms of your individual residency agreement.
• By us: Birchwood Rest reserves the right to decline or discontinue services in cases of safety concerns, breach of house rules, or circumstances that make continued residency unsuitable. We will handle such situations with sensitivity and appropriate notice.
• Surviving clauses: Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination of this agreement.

13Dispute Resolution

We hope any concerns can be addressed through open and respectful conversation. If a disagreement arises, we encourage you to contact us first so we can work toward a resolution together.

• Governing law: These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
• Jurisdiction: Any legal proceedings shall take place in the courts of Toronto, Ontario, unless otherwise required by applicable law.
• Informal resolution: We ask that you contact us at [email protected] in writing before initiating any formal proceedings, to allow a 30-day period for informal resolution.
• Consumer rights: Nothing in these terms limits any rights you may have under the Consumer Protection Act, 2002 (Ontario) or other applicable Canadian consumer protection legislation.

• Entire agreement: These Terms & Conditions, together with our Privacy Policy and Cookie Policy, constitute the complete agreement between you and Birchwood Rest with respect to website use and initial service inquiries.
• Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force and effect.
• Waiver: Failure by Birchwood Rest to enforce any term does not constitute a waiver of our right to do so in the future.
• Assignment: You may not assign your rights or obligations under these terms without our written consent. Birchwood Rest may assign its rights in connection with a business transfer, merger, or acquisition.
